September 2017

Another Planning Application has been received for: Raising of existing bunding to motorcycle track to a minimum of 2.0m above the highest part of the existing track level as required by condition 7 of planning permission reference CB/14/03678/VOC.

Please note that there is a request to change the bunding specification as required by condition 7 of planning permission reference CB/14/03678/VOC,  as can be seen from the Revised LBM-17 Bunds Planning Statement document included with the application.

Original application is SB/95/00176/Full and agreed hours: Mon - Sat 10.00 -12.30, lunch break, 16.30 - 17.00 and Sun 10.00 - 14.00

  

January 2015

The Committee Meeting was held at 10 am on Wednesday 14th January 2015, at CBC offices, Chicksands in Shefford.

Stanbridge, Eaton Bray and Billington were all represented, and members from all 3 Parish Councils spoke against the planning request along with a number of local residents from the 148 who objected.  Mark Versallion also spoke on our behalf and against the application.

The site operator and one other spoke for the application.

The Committee voted 7-3 in Favour.

Therefore the operator will be able to run the Motocross from October 1st to 30th April with 18 bikes (7 months) on Friday, Saturday and Sunday 10-1 pm and 1:30-3:30 pm.

Prior to October 1st, the current permissions will remain in place: 7 bikes 10-12:30 pm and 2:30-5 pm.

Tuesday 6 January 2015 (proposed date) - David Hale has been asked to meet with Parish Councils prior to CBC Development Managment Committee Meeting.

Sunday 11 January 2015 4 pm - Rye Farm, Eaton Bray - meeting for any residents to review application and organise objections prior to CBC Development Meeting.

Wednesday 14 January 2015 10 am - CBC Development Management Committee Meeting, Council Chamber, Chicksands, Shefford, SG17 5TQ, to decide Planning Application.

 

The Motorcycle Track south of Billington Road has submitted a new planning application, to extend their operating hours to 7 months a year, from 1st October till 30th April, opening every Friday, Saturday and Sunday from 10 till 4 with only a half hour lunch break.

PREVIOUS APPLICATIONS

15 November 2013 - The existing planning permission for the track which dates back to 1995, allows it to be used only between 1 April and 30 September each year. The track continued to operate at weekends after 30 September 2013, which was unlawful and also constituted non-compliance with the Breach of Condition Notice which was served in January 2013 in similar circumstances.

Attempts to stop the use of the track were not successful until CBC decided to seek a High Court Injunction requiring compliance with the Notice.

Once the landowner and track operator were made aware of this, they immediately decided not to open the track again outside of the April to September period.  The track has not been used for the last two weekends. CBC will proceed with the Injunction if the track opens again before 1 April 2014.

As things stand, the track can re-open under the 1995 permission on 1 April 2014.  The operator has indicated that he intends to submit a further planning application to vary the conditions of the 1995 permission but no application has yet been received.

 

3 November 2013 - The recent planning request by the motorcross site for extended operating hours and an increase number of bikes using the track has been declined.  This means the site that is operating this weekend are operating illegally.  The Parish Council are continuing to work with CBC who will now be taking further action.

Thank you to all the residents who took the time to write to CBC and support the objection put forward by the parish;  CBC are aware of the illegal actitvity and are planning further enforcement measures.

 

19th October 2013 - The Parish Council have again submitted a strong objection to the current change of hours for the Dunstable Motocross site on Billington Rd.  We have also expressed our concern that the site is continuing to operate every weekend in October in contravention of the existing planning permission which only allows the site to operate from the 1st April to 30th September. 

 

22nd September 2013 - The Motorcross Site has yet again been served with another breach of condition notice due to the continued breraching of the hours restrictions.

The motocross site has recently been submitting planning requests to increase the usage of the site. These have been refused by CBC and as the site has been operating over this winter contrary to its conditions, CBC has issued a breach of conditions notice to prevent further operations outside the allowed hours.  The owners have now submitted further planning requests to operate all year round based on the fact that this site has been operating all year round for the last 10 years.


The Parish Council believes this site causes a noise nuisance that disturbs the quality of life for its residence.  We believe the site had not been operating continually for the last 10 years and so there were no grounds to change the current conditions.  Along with many residents from both Stanbridge and Eaton Bray, we wrote to CBC planning office to object to the planning request stating the conditions for use should remain as they are.  At closure, 88 people had responded, only one of which was in favour. CBC will make a decision on the current application to extend the hours of use around the 18th April.  We are not saying the motocross site should be removed, just that it should continue to operate within its current conditions.

The motocross site on Stanbridge Road, close to the A505, has recently been operating through the winter with a large number of bikes, contrary to its original planning permission; please see below.

Conditions or Reasons for Planning Application - SB/95/00176/

3. This permission shall only extend to the use of the site for the purpose of motor cycle training and practice between the 1st April and 30th September in any calendar year.

REASON: To enable the District Planning Authority to exercise proper control over the development in the interests of general amenity.

4. The site shall be used for the purpose hereby permitted only between the hours of 10.00am to 12.30pm and 2.30pm to 5.00pm Mondays to Saturdays and between the hours of 10.00am to 2.00pm on Sundays or Public Holidays.
